1. Acceptance of Terms

Welcome to Imbaaki, a social networking platform designed to help users share and compare purchase information to make informed buying decisions. By accessing or using Imbaaki (the “Platform”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree with these Terms, you must not use the Platform.

2. Eligibility

You must be at least 13 years old to use the Platform. By registering for an account, you represent and warrant that you meet this age requirement and that all information you provide is accurate and truthful.

3. Account Registration and Security

To access certain features of the Platform, such as posting purchase information, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your password and account credentials.
• Notify us immediately of any unauthorized use of your account.

Imbaaki uses Google reCAPTCHA to prevent automated abuse. By using the Platform, you agree to comply with Google’s Terms of Service and Privacy Policy for reCAPTCHA.

4. User Content

Imbaaki allows users to share purchase information, including item details, quantities, prices, locations, and optional notes. By posting content, you agree to the following:

• Your content must be accurate, lawful, and not misleading.
• You grant Imbaaki a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content on the Platform for the purpose of operating and improving the service.
• You are solely responsible for the content you post, including its accuracy and compliance with these Terms.

Imbaaki reserves the right to remove or moderate any content that violates these Terms or is deemed inappropriate, including but not limited to content that is offensive, fraudulent, or in violation of applicable laws.

5. User Conduct

You agree not to use the Platform to:

• Post false, inaccurate, or misleading purchase information.
• Engage in harassment, hate speech, or discriminatory behavior.
• Violate any local, national, or international laws or regulations.
• Attempt to manipulate or falsify price data to mislead other users.
• Use automated tools or scripts to scrape or extract data from the Platform without permission.

Violation of these rules may result in account suspension or termination.

6. Price Comparison and Currency Conversion

Imbaaki provides tools to compare prices based on user-submitted data. All prices are converted to Ugandan Shillings (UGX) using a fixed exchange rate of 1 USD = 3700 UGX for consistency. Imbaaki does not guarantee the accuracy of user-submitted data or the reliability of price comparisons, and you use this information at your own risk.

7. Google Maps Integration

The Platform integrates with Google Maps to provide location-based features, such as linking purchase locations to maps for directions. By using these features, you agree to comply with Google’s Terms of Service and Privacy Policy.

8. Intellectual Property

All content, design, and code on the Platform, including the Imbaaki child theme, are the property of Imbaaki or its licensors and are protected by copyright and other intellectual property laws. You may not copy, modify, or distribute any part of the Platform without express permission.

9. Privacy

Your use of the Platform is subject to our Privacy Policy, which outlines how we collect, use, and protect your personal information. By using Imbaaki, you consent to the collection and use of your data as described in the Privacy Policy.

10. Limitation of Liability

Imbaaki is provided on an “as-is” and “as-available” basis. We do not warrant that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components. To the fullest extent permitted by law, Imbaaki shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the Platform.

11. Termination

Imbaaki reserves the right to suspend or terminate your account or access to the Platform at any time, with or without notice, for any reason, including violation of these Terms.

12. Changes to Terms

We may update these Terms from time to time. You will be notified of significant changes via the Platform or by email. Your continued use of the Platform after such changes constitutes your acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Uganda. Any disputes arising from these Terms or your use of the Platform shall be resolved in the courts of Uganda.

• With Third-Party Service Providers: We use third-party services like Google Maps and reCAPTCHA. These providers may process your data in accordance with their own privacy policies (see Google’s Privacy Policy).
• Legal Compliance: We may disclose your information if required by law, regulation, or legal process, or to protect the rights, safety, or property of Imbaaki, its users, or the public.

We do not sell your personal information to third parties.

5. Data Storage and Security

We store your information on secure servers and implement reasonable security measures to protect it from unauthorized access, loss, or misuse. However, no system is completely secure, and we cannot guarantee the absolute security of your data.

Purchase data is stored with metadata (e.g., item, price, location) to enable filtering and comparison features. We retain your data for as long as your account is active or as needed to provide the Platform’s services, unless you request deletion (see Section 7).

The Platform integrates with Google Maps to provide location-based features and Google reCAPTCHA to prevent automated abuse. • Delete: You may request deletion of your account and associated personal data by contacting us at support@imbaaki.com. Note that public purchase data may remain visible unless specifically requested for removal, subject to our discretion.
• Opt-Out: You can opt out of non-essential communications by adjusting your account settings or contacting us.

To protect your privacy, we may require verification of your identity before processing requests related to your data.

8. Cookies and Tracking Technologies

We use cookies and similar technologies to enhance your experience, track usage, and maintain session data. You can manage cookie preferences through your browser settings, but disabling cookies may affect the Platform’s functionality.

9. Children’s Privacy

The Platform is not intended for users under 13 years of age. We do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided personal information, we will take steps to delete it.
